Sarga — User Agreement & Privacy Policy

1. General Provisions & Acceptance

1.1. The Service is open for public use, subject to these Terms.

1.2. By completing the registration (providing a phone number and password) and using the Service, you confirm that you have read, understood, and agree to all conditions of this Agreement.

1.3. This Agreement remains in effect for as long as you use the Service.

1.4. Sarga reserves the right to make changes and additions to this Agreement unilaterally. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Agreement.

1.5. Special conditions may apply to certain pages or sections of the Service. By using those sections, you agree to the applicable special conditions.

2. Client Rights and Obligations

2.1. You agree to use the Service in full compliance with these Terms and the applicable legislation of Turkmenistan.

2.2. You are fully responsible for the accuracy of the information provided during registration and use of the Service. You agree to bear responsibility for any damages caused to Sarga resulting from inaccurate information.

2.3. You are responsible for maintaining the confidentiality of your account login credentials (phone number, password). You agree not to transfer this information to third parties. You are solely responsible for all actions that occur under your account.

2.4. You must not use another person's IP address, email address, username, or other personal information without authorization.

2.5. You must not take any action that obstructs or complicates the use of the Service by other users. Such actions may result in the termination of your account and may subject you to legal and financial liability.

3. Service Termination and Account Deletion

3.1. Company-Initiated Termination

3.1.1. Sarga has the right to suspend or terminate (temporarily or permanently) your access to the Service, in whole or in part, without prior notice if you violate the laws of Turkmenistan or the terms of this Agreement.

3.1.2. Sarga also reserves the right, at its sole discretion, to cease providing the Service to all users or to any individual user at any time, with or without notice.

3.2. User-Initiated Account Deletion

3.2.1. You may request account deletion at any time through the app settings.

3.2.2. Deletion requires explicit confirmation to prevent accidental requests.

3.2.3. Your account will be deactivated immediately upon confirmation. You will not be able to log in or access account features.

3.2.4. Permanent deletion occurs 30 days after the request date.

3.3. Restrictions on Deletion

3.3.1. Accounts with active orders (pending, approved, ordered, or arrived at warehouse) cannot be deleted.

3.3.2. You must either cancel pending orders or wait for them to be completed/delivered/cancelled before requesting deletion.

3.3.3. This protects both you and the platform from fraudulent transactions and ensures fulfillment of contractual obligations.

3.3.4. Orders with status "shipped," "cancelled," or "returned" do not block deletion.

3.4. Effect of Deletion Request

3.4.1. Your account will be deactivated immediately upon deletion request.

3.4.2. You can still log in to cancel your deletion request during the 30-day grace period.

3.4.3. You will not be able to create new orders while deletion is pending.

3.4.4. Outstanding orders must be fulfilled or cancelled before deletion.

3.4.5. All personal data will be permanently removed after 30 days.

3.5. Cancellation of Deletion

3.5.1. You may cancel your deletion request within 30 days through the app settings.

3.5.2. After cancellation, your account will be fully reactivated.

3.5.3. If the 30-day period expires, deletion is final and irreversible.

4. Prohibited Goods, Services, and Actions

Sarga may terminate this Agreement immediately and without notice if you attempt to buy, sell, or promote any of the following prohibited items or services:

• Intimate services, erotic materials, adult goods (including sex toys, condoms, and revealing or transparent lingerie).
• All types of weapons (hunting, pneumatic, airsoft, civilian, etc.), including bladed weapons (except kitchen, pocket, or office knives), components, accessories, and replicas.
• Ammunition, military equipment, rocket fuel, explosives, pyrotechnics, lasers, toxic agents, and military/law-enforcement uniforms or equipment.
• Alcoholic beverages, spirits, and devices for their production.
• Tobacco, tobacco products, electronic cigarettes, hookahs (including components and consumables), and smoking accessories (except lighters and ashtrays).
• Human organs, tissues, donor services, or surrogacy services.
• Currency (coins and banknotes) currently in circulation.
• State awards and medals.
• Services for writing or providing pre-written academic work (diplomas, theses, etc.).
• Securities (stocks, bonds, checks, etc.), except for collectible items clearly marked as expired or invalid.
• Poisons, narcotic drugs, and psychotropic substances.
• Goods containing radioactive substances, isotopes, uranium, or other fissile materials.
• Goods or services intended to deceive users or government bodies (e.g., fake identity documents, passes, medical certificates, blank forms, license plate flippers, odometer correction services, counterfeit money, neodymium magnets).
• Technical means for covert information gathering (e.g., spy equipment) and encryption technology.
• Goods or services with no consumer value; transcendental services (e.g., witchcraft, magic, non-traditional medicine).
• Objects of cultural or archaeological heritage as defined by the laws of Turkmenistan.
• Services for installing illegal software copies or modifying factory settings (e.g., "flashing," "unlocking," "jailbreaking").
• Extremist materials or goods with Nazi symbolism.
• Rare and endangered animals and plants, or products made from them.
• Gambling or lottery equipment.
• Sale or rental of phone numbers, SIM cards, or cable TV cards.
• Financial services, insurance, stock/Forex trading education, bankruptcy services, financial intermediation, or debt collection services.
• Virtually transmitted materials not recorded on physical media (e.g., ideas, methods, electronic tickets).
• Aquatic biological resources or animals obtained from illegal fishing or hunting.
• Precious and rare-earth metals, precious stones (except for finished jewelry).
• Counterfeit goods or stolen property.
• Foreign currency and other currency values (except for numismatic/collection purposes).
• Goods or services that violate personal privacy or contain state, banking, commercial, or other protected secrets.
• Phone numbers, email addresses, or other contact details of third parties without their consent.
• Services for "boosting," "promoting," or creating artificial traffic on social networks or similar resources.
• Any other goods or services whose circulation is prohibited by the legislation of Turkmenistan.

5. Disclaimer of Warranties and Limitation of Liability

5.1. The Service is provided on an "as is" and "as available" basis. Sarga makes no warranties, express or implied, regarding the reliability, timeliness, or error-free operation of the Service.

5.2. To the fullest extent permitted by law, Sarga shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

6. Governing Law

This Agreement shall be governed and interpreted in accordance with the legislation of Turkmenistan.

This Privacy Policy explains how Sarga collects, uses, shares, and protects your personal information when you use our Service.

7. Information We Collect

To provide you with high-quality service, we may collect the following personal information:

• Identifying Information: Your first and last name.
• Contact Information: Your email address, phone number, and delivery address.
• Demographic Information: Your gender and date of birth.
• Account Information: Your password and account settings.

8. How We Use Your Information

We use the information we collect for the following purposes:

• To create and manage your personal account.
• To process and fulfill your orders and communicate with you about them.
• To inform you about services, promotions, and discounts (marketing).
• To understand customer demand and improve our product offerings.
• To conduct trend analysis and internal statistics to improve our Service.

9. How We Share Your Information

Your information may be shared in the following limited circumstances:

• Service Providers: With third-party companies that we work with to perform services on our behalf (e.g., delivery companies, payment processors). We ensure these partners adhere to strict confidentiality and data protection standards.
• Legal Compliance: With relevant state bodies or other third parties when we are required to do so by law, or to protect our rights, property, or safety, or the rights, property, or safety of our users or others.
• Business Transfers: In connection with a merger, acquisition, or sale of company assets, your information may be transferred to the new entity.

Other than as described above, your information is not transferred to any third parties for commercial purposes or sold for any reason. Sarga is committed to protecting your data.

10. Data Security

We take reasonable administrative, technical, and physical security measures to protect your personal information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. However, no internet transmission is 100% secure, and we cannot guarantee absolute security.

11. Your Rights and Choices

You have rights regarding your personal information.

• Access and Correction: You have the right to access the personal information we hold about you. If any information is inaccurate or incomplete, you may request that we correct it.
• Marketing Communications: You can opt-out of receiving promotional communications from us by following the instructions in those communications or by changing your account settings.

12. Right to Account and Data Deletion

Users have the right to request deletion of their account and personal data at any time, subject to the following conditions:

12.1. Deletion Process

• Upon requesting account deletion through the app settings, your account will be immediately deactivated.
• You can still log in during the 30-day grace period to cancel your deletion request.
• You cannot create new orders while deletion is pending, but can view existing orders and account information.
• Your account and all associated personal data will be permanently deleted after 30 days.
• During the 30-day grace period, you may cancel the deletion request through the app to restore full account access.
• You cannot request deletion if you have active orders (pending, approved, ordered, or arrived at warehouse).

12.2. Active Orders

• Accounts with active orders cannot be deleted until orders are completed, cancelled, or delivered.
• This ensures fulfillment of contractual obligations and prevents fraud.
• Orders with status "pending," "approved," "ordered," or "arrived" (at warehouse) block deletion.
• Orders with status "shipped," "cancelled," or "returned" do not block deletion.
• Once all orders are completed, cancelled, or delivered, deletion can be requested.

12.3. Data Retained

• After permanent deletion, we retain minimal transaction records for legal and accounting purposes as required by law.
• Anonymized analytics data may be retained for business insights.
• All personally identifiable information is permanently removed.

12.4. Cancellation Period

• You have 30 days to cancel your deletion request.
• After 30 days, deletion is permanent and cannot be reversed.
• To cancel, access your account settings in the app within the grace period.

12.5. Data Deleted

The following information will be permanently deleted:

• Personal profile information (name, email, phone number)
• Delivery addresses
• Order history (except minimal records required by law)
• Shopping cart and wishlist items
• Account preferences and settings
• Authentication credentials

13. Children's Privacy

The Service is not intended for or directed at children under the age of 13 (or the equivalent minimum age in the relevant jurisdiction). We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child, we will take steps to delete that information as quickly as possible.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email (sent to the email address specified in your account) or by means of a notice on the Service prior to the change becoming effective.
